AI agent for WhatsApp Business: Meta's 2026 rules and costs

An AI that serves your own business's customers is allowed on WhatsApp: since 15 January 2026 Meta only bans general-purpose assistants. It replies within 24 hours, and you pay for the message (1,000 free a month per number, then €0.0166 in Spain) plus the AI.

Is it allowed to put an AI on WhatsApp?

Yes, if the AI serves your business's customers. What Meta has banned since 15 January 2026 is using WhatsApp to offer an AI assistant as the product itself.

The rule is section 4.7 of the terms of the WhatsApp Business Platform. It targets "AI Providers": whoever develops large language models, generative AI or general-purpose assistants. It bars them from offering that technology on WhatsApp when it is the primary functionality, "rather than incidental or ancillary".

Where the law requires Meta to accept those general assistants, it charges them separately. As of 30 September 2026, that rate only applies to users in Brazil; in the European Economic Area it applied until 12 May 2026. A business using AI with its own customers is not affected: it pays the same as any other.

What can the AI do, and what can't it?

The AI can reply with free text, photos, documents, lists or buttons during the 24 hours after the customer's last message. It cannot write first with a text of its own.

Every message or call from the customer opens the 24-hour window, or resets it. A tool can send a template on its own, such as an appointment reminder, but Meta approved its text beforehand: the guide to WhatsApp templates explains how.

Inside the window, a good AI replies at once, at any hour: opening hours, prices, availability. It asks for the details the team needs, books appointments if it is connected to your calendar, and hands the chat to a person when it doesn't know. An agent like BlueMarlin's answers with your business's information and each customer's record, and behaves differently with a prospect, a customer or a tenant.

What it must not do:

  • Make things up. Meta warns that the messages of its own agent "may not be accurate or appropriate". It holds for any AI: it should only answer with what you give it.
  • Ask for full numbers of a card, a bank account or an ID document. WhatsApp's policy forbids it, whether a person or an AI asks.
  • Pass itself off as a person. Since 2 August 2026, the EU AI Act requires that whoever talks to an AI knows it from the start, unless it is obvious.

How much does an AI on WhatsApp cost?

With a third-party AI you pay Meta for the message and the provider for the AI. Meta Business Agent charges it all together, by tokens. Rates for Spain, before VAT, from 1 October 2026:

An example: 1,500 replies a month.

  • A third-party AI, for example BlueMarlin's: Meta charges 500 replies × €0.0166 = €8.30. The AI, at 1 cent a reply, €15.00. Total: €23.30. On the Business plan, the AI comes out of the €40 included each month (BlueMarlin's prices as of 30 September 2026).
  • Meta Business Agent: 1,500 × 4–5 US cents = about $60–75.

Meta charges per message, and one reply can take several. In Meta's own example, a customer asking "What time do you open?" receives 4 messages, which cost about 16–20 US cents.

In the phone app, Meta Business Agent is free each month up to an included allowance, and the paid Meta One plans add more replies. Meta does not publish how many replies that allowance holds. What Meta charges for each kind of message is in what WhatsApp costs.

Meta Business Agent or a third-party AI?

Meta Business Agent is the quickest way to start, if your business can use it. A third-party AI gives you more control: what it knows, who it talks to, who takes the chat over and what happens to the data.

When Meta's is enough. If you run a small shop, use only the app and get asked the same things again and again, Meta Business Agent may be enough. Starting costs nothing.

When a third-party AI pays off. When you want it to answer with each customer's data, when the team has to see and take over every conversation, or when your sector is excluded, like a clinic. Bear in mind that a number has only one agent: Meta will not turn its own on if another one is already integrated.

When does a person have to reply?

When there is a complaint, a negotiation, sensitive data or a decision that really affects the customer. And whenever the customer asks.

  • The customer asks to talk to someone. WhatsApp's policy requires a clear way to reach a person: handing the chat over, a phone number, an email, the website, the shop or a form.
  • Complaints. They need someone who can decide: refund, compensate, apologise.
  • Negotiation. A discount, an offer on a flat, the terms of a contract. The AI takes the proposal down; a person gives the answer.
  • Sensitive data. Health is a special category under the GDPR (Article 9). Card, account or ID numbers are not asked for on WhatsApp.
  • Decisions with consequences. Accepting a tenant or granting finance. The GDPR (Article 22) gives the right not to be subject to a decision taken solely by a machine that has legal or similarly significant effects and, where it is allowed, to ask for a person to step in.
  • When the AI doesn't know. "Let me pass you to the team" beats a made-up answer.

What about your customers' privacy?

Your customers have to know an AI reads their messages, and you decide who may use those conversations.

  • Meta Business Agent in the app: WhatsApp tells the customer, the first time, that Meta's AI receives the chats to improve its AI. According to Meta, it keeps collecting them even while you mute the agent, until you delete it.
  • Meta Business Agent over the API: its terms, dated 16 July 2026, let Meta use the content to improve its AI models.
  • A third-party AI: the platform terms (section 4.7) forbid you to let your WhatsApp data train or improve AI models, except fine-tuning one for your exclusive use. Ask your provider how they comply.

Frequently asked questions

Can I use ChatGPT on my business WhatsApp?

Not as a general assistant that answers anything: since 15 January 2026 Meta does not allow it, except where the law requires it to. You can use an AI model, from OpenAI or another provider, inside a tool that serves your customers about your business. What counts is what it is used for, and Meta has the final say.

Does an AI reply cost more than one from a person?

No. Meta charges a service message the same, whether a person or a third-party AI writes it: 1,000 free a month per number, then €0.0166 in Spain. You pay the AI provider separately. Only Meta Business Agent has a price of its own, by tokens.

Can the AI message a customer who hasn't written to me?

Not with free text. Once 24 hours have passed since the customer's last message, only templates approved by Meta can be sent, and only to people who agreed to receive your messages. A tool can send an automatic template, such as an appointment reminder.

Do I have to say it is an AI?

Yes, and best from the first message. Since 2 August 2026, the EU AI Act requires that people know they are talking to an AI, unless it is obvious; the duty falls on the provider of the system. Meta's own agent terms also forbid presenting its replies as written by a person.

Does it work with the free WhatsApp Business app?

Meta Business Agent does: you turn it on in the Tools tab, if your business is eligible in your country. A third-party AI needs the official API. With coexistence, you connect the same number and keep using the app on your phone, with the history in sync.
